網路服務提供者民事免責事由問答集

由於各類網路侵權行為皆需透過網路服務提供者（Internet Service Provider, ISP）提供之服務予以遂行，造成ISP時常需面對被控侵權之訴訟風險，實不利網路產業之發展。智慧財產局為解決此一問題，爰參考國際間各國作法，於98年5月13日公布新增著作權法第6章之1「網路服務提供者之民事免責事由」條文。為使ISP業者及各界瞭解條文內涵，本資料整理條文常見問題及解答，期使著作權人與ISP能共同合作、落實著作權保護。
